Since 2002, the Interstate Compact for Adult Offender Supervision has allowed people on probation to transfer probation from state to state – including Washington DC, Puerto Rico, and the US Virgin Islands – without having to petition the court. There is a process that must be followed to receive approval for the transfer.
The basic requirements to transfer your probation under the Interstate Compact are (1) you must have more than 90 days of supervision remaining, (2) you must create and have a valid supervision plan, (3) you must be in substantial compliance with the terms of your supervision, (4) you must be a resident or have resident family in the state you want to transfer to, and (5) you must be able to get a job or have a means of financial support in the state you want to transfer to.
Even if you meet all of the requirements to transfer your probation under the Interstate Compact you may still NOT be approved for the transfer. If you are approved for a probation transfer the terms of your probation MAY change.
