Quality Defense Services Are Multifaceted

Understanding What We Will Do For You

As your DUI defense attorneys, we take control of the entire legal process, managing it from beginning to end.  This means you do not have to worry about any of the administrative tasks — we make sure everything is completed appropriately and on time. You can count on us to:

Gather Information: We begin each new case with a meeting to understand exactly what happened.  This provides us the opportunity to identify any relevant issues regarding how your DUI charges were made and the manner in which you were treated. We will determine whether your rights were violated and address those issues appropriately.

Investigate Your Case: The key to building a successful defense lies in understanding all of the information regarding your case. While your side of the story is critical, it is also important that we fully comprehend the charges brought and uncover all of the associated details.  As such, we will carefully review the evidence against you including police reports and breathalyzer results, and we will take the time to personally interview all available witnesses. We know the right questions to ask to gain a complete picture of your situation.

Communicate Efficiently and Effectively: This is a multi-pronged step. First and foremost, we are always available to answer your questions and address your concerns. They are all valuable and deserve our attention.  We will also keep you apprised of the progress of your case.  Additionally, we assume responsibility for all communications with the court system and other attorneys. Thus, we will ensure paperwork is filed correctly and in a timely manner and will interact, on your behalf, with everyone related to your case.

Safeguard Your Rights and Your Future: Our ultimate goals are to reduce the stress and anxiety associated with legal action and minimize the impact of these charges on your life. In each case, this looks different. Whether we are negotiating a lesser sentence, strategizing and building your defense, or representing you in court, we will work tirelessly for you.

With Taracks & Associates as your DUI defense lawyers, you can rest assured that your case is receiving our full attention; we will leverage the resources of our firm on your behalf.

A Window Into a Second DUI Charge

Penalties Are Serious

As an individual facing DUI charges for the second time, it is important that you recognize the penalties you are facing; they are more severe than those associated with first-time offenders.

The impact of driving under the influence for the second time, in all cases, may include probation, community service, criminal record, increased car insurance rates, and even future civil charges.

Of course, possible sentences can vary depending upon the circumstances of your situation.

Some factors that may contribute to the severity of your sentence include property damage, injury or death to others, and your legal record. Additionally, blood alcohol level (whether below .15 or above), car passengers (minors under the age of 18), and time between charges (more or less than five years) can impact the severity of the punishment. Below we have shared the parameters and associated penalties.

BAC Below .15 and/or No Minor Passengers

  • Significant fines ranging between $1,000 and $2,000
  • Jail time of up to nine months.

BAC .15 or Higher and/or Minor Passenger in the Car

  • Monetary fines ranging from $2,000-$4,000
  • Prison time of up to 12 months.

Finally, if your two offenses occurred more than 5 years apart, you could lose your license for 180 days.  However, if the incidents occurred more frequently, you would face a mandatory sentence of at least 10 days in prison, 48 hours of which must be consecutive, and you could face a revocation of your driver’s license for five years.

The impact of these implications are serious.  Engaging a seasoned DUI defense attorney who understands the Tampa legal landscape is an important step to take.
