A Window Into a Second DUI Charge

Penalties Are Serious

As an individual facing DUI charges for the second time, it is important that you recognize the penalties you are facing; they are more severe than those associated with first-time offenders.

The impact of driving under the influence for the second time, in all cases, may include probation, community service, criminal record, increased car insurance rates, and even future civil charges.

Of course, possible sentences can vary depending upon the circumstances of your situation.

 

Some factors that may contribute to the severity of your sentence include property damage, injury or death to others, and your legal record. Additionally, blood alcohol level (whether below .15 or above), car passengers (minors under the age of 18), and time between charges (more or less than five years) can impact the severity of the punishment. Below we have shared the parameters and associated penalties.

BAC Below .15 and/or No Minor Passengers

  • Significant fines ranging between $1,000 and $2,000
  • Jail time of up to nine months.

BAC .15 or Higher and/or Minor Passenger in the Car

  • Monetary fines ranging from $2,000-$4,000
  • Prison time of up to 12 months.

Finally, if your two offenses occurred more than 5 years apart, you could lose your license for 180 days.  However, if the incidents occurred more frequently, you would face a mandatory sentence of at least 10 days in prison, 48 hours of which must be consecutive, and you could face a revocation of your driver’s license for five years.
