How the process works

In Florida, a Petitioner (person filing for an injunction) can go to the court house and file paperwork describing acts of domestic violence that have occurred. For people in a relationship (sexual, dating, living together, have a child together) only one act of violence is required. For those not in a relationship (friends, neighbors, co-workers) two acts are required. One of the acts must occur within six months.

A judge will review the petition the day it is filed and determine whether or not the allegations alone would be enough to grant the injunction. If so, a temporary injunction will be issued for approximately 14 days. During that time you (the respondent) will not be permitted to contact or come within 500 feet of the petitioner, his or her work place, his or her school, or his or her children (if applicable.)

On or about the 14th day, a trial will be held. You will be required to appear and possibly present your defense. This is where having an skilled attorney comes into play.
