Highway Racing (AKA street racing, drag racing, etc.) is a misdemeanor criminal traffic offense governed by Florida statute. Highway racing can involve any types of street vehicle, including cars, motorcycles, and SUV’s. What many people do not realize is that a conviction for highway racing carries serious penalties, including a criminal record, an automatic one-year suspension of your driver’s license and increased insurance premiums. There is also a hefty fine, and in some rare instances, a driver may face jail time. We recently sat down with Tampa criminal defense attorney Frank Kerney to discuss street racing and what you should do if you have been cited for this criminal offense.
“What most people don’t realize is that a first time ticket for street racing may result in a $1,000 fine and up to a year in jail, plus a criminal record. Most people just go down to the Court house, plead guilty or no contest, and take the fine without realizing that they now have a criminal record. In other words, they think it’s just a regular civil citation like speeding. What makes it so much more serious is that a second offense can bring similar penalties, but may also include revocation of your driver license for up to two years. Worse yet, every offense after that will result in the forfeiture of your car or motorcycle on top of fines and the very real possibility of jail time.”
“If you have been cited for highway racing, it is important that you call a criminal defense lawyer who can provide you with legal help in your case and ensure your rights are protected. Don’t just go down to the Court house and plead guilty or no contest. You should consider fighting this charge and having it reduced or dismissed altogether. This is especially true if you are a young person looking to go to school or start a career. You don’t want to enter today’s job market with a criminal record, even if it is just a misdemeanor charge of highway racing.”
