Guardian Interlock Device | Taracks & Associates

Fla. Stat. § 316.1937 provides that certain convicted DUI offenders shall be ordered to have an ignition interlock device installed on their car prior to making an application for a restricted license in the following circumstances:

  1. Discretionary for a First DUI Conviction with a BAC of .08 or above for a period of at least 6 months. Fla. Stat. § 316.193(2)(c).
  2. Mandatory for a First DUI Conviction with a BAC of .15 or above, or a minor was in the car at the time of driving, for a period of at least 6 months. Fla. Stat. § 316.193(4)(c).
  3. Mandatory for a Second DUI Conviction for a period of at least one year. Fla. Stat. § 316.193(2)(a)3.
  4. Mandatory for a Second DUI Conviction with a BAC .15 or above, or a minor in the car, for a period of at least 2 years. Fla. Stat. § 316.193 (4)(c).
  5. Mandatory for a Third DUI Conviction for a period of at least 2 years. Fla. Stat. § 316.193(2) (b)(2).
  6. Mandatory for a Fourth or Subsequent DUI Conviction for a period of at least 5 years. Fla. Stat. § 322.2715(3)(f).

These devices are installed in the vehicle that you drive, and you must blow into the device to start your car. If you fail properly blow or you register .025 or higher, your car will not start.

The Court-ordered ignition interlock device will have to be installed on the motor vehicle that you operateprior to applying to the DHSMV for a work permit or reinsLink to a Pagetated driver’s license after your DUI Conviction. You must pay for the installation of the device, and the average cost for the installation of the device is currently $70.00.

In addition to the installation cost for the ignition interlock device, you will also have to bring your car back to the location every month for device monitoring and calibration at an additional cost that ranges from $65.00 to $75.00.
