Violation of Probation

If you are on probation for a Misdemeanor or Felony charge and violate a condition of that probation or pick up a new charge, then you will be charged with a Violation of Probation. Common violations include not paying the cost of supervision, not paying court ordered restitution, not reporting as required to the case assigned probation officer, and testing positive for contraband. 

Q: What should I do if violated my probation but my Probation Officer does not know about it yet?
A: Contacting an Attorney early can potentially prevent you from having  a warrant for your arrest issued, and prevent you from having to turn yourself and wait in custody until you are brought before a Judge on your Violation Arraignment. We try to bring our clients before the Court on our motion, which shows the court that you are taking responsibility early for the violation and avoids you having to go before the Judge while in custody.

Q: What kind of sentence can I expect if I am found guilty of the violation?

A: Depending on the violation, the Judge can reinstate your probation with modifications, extend your probation, reinstate your probation with the same terms and conditions, or terminate your probation and sentence you accordingly.
