
When you are arrested Florida Law requires you to be brought before a Judge within 24 hours of your arrest to determine whether or not you are eligible to be released during the State’s prosecution. When you go before the Judge, the Judge can release you on your own recognizance, release you on the condition that you post a reasonable bond, or deny you a bond and hold you in custody for the duration of your case.
The purpose of the bail bond requirement is to ensure the appearance of the Defendant at subsequent proceedings and protect the community against unreasonable danger from the criminal Defendant. When making the determination, the Judge will consider the nature and circumstances of the offense charged, the weight of evidence against the Defendant, the Defendant’s family ties, length of residence in the community, employment history, financial resources, and mental condition, the Defendant’s prior criminal history, if any, and any prior failures to appear, if any, and any other facts that the court deems relevant.
