Testing Over The Legal Limit
Anthony Rickman discusses possible defenses if you tested over the legal limit for DUI.
Often people ask, well I blew over the legal limit why do I need an attorney. It's important to get an attorney, if you blew over the legal limit. If you blew over the legal limit most likely your license is suspended for a period of six months. The first thing our lawyers can do is get you a hardship licenses to get you back in the street and contest the blow that the State says they have against you. Often times the machine does not work correctly and the blow that you gave in that machine is not reflective of your true blood alcohol level at the time when you were actually driving your motor vehicle. In addition to that just because you may have blown over the legal limit does not necessarily mean what happened prior to you blowing is legal. For instance, if the office lacked the proposal cause to stop your vehicle it's very possible that the case could stop at that point in time and your blood alcohol level is not necessarily relevant because the office had no reason to stop your vehicle. Thereby suppressing the stop and dismissing the entire case.
In addition to that we can also look in the machine was working correctly, look at the inspection records to make sure that it was functioning when you blew in the test and also throughout the whole year and the month prior to you blowing into the machine. Let our attorneys do the leg work for you.
