Anthony Rickman Featured on Fox 13 Tampa Bay

Taracks Gomez & Rickman partner Anthony Rickman was featured on Fox 13 Tampa Bay last night regarding FDLE and the admissibility of breath test results in DUI cases:

But Tampa defense attorney Anthony Rickman believes breathalyzers are unreliable. In fact, he says he's had several DUI cases dismissed in court because of flawed results.

"First thing we do when one of these cases comes across our desk, the first thing we're looking at is, was this machine working correctly?" said Rickman.FDLE recently fixed machines that had flawed results with their breath volume, which ensure the air comes from the deep part of the lungs.

But Rickman says the problems still exist."You see a high volume of breath when there is no humanly possible way that this person could have given this volume. The problem is there is no calibration of flow sensor. FDLE's answer is it doesn't mean anything," Rickman said.
