Our client (a mother) was accused by her husband of throwing a beer bottle and hitting him in the head. The Defendant was in her vehicle when law enforcement conducted a traffic stop for illegal window tint and a cracked taillight. As Law Enforcement approached the vehicle they observed an individual move from the driver's seat to the rear seat and another person move from the rear seat to the driver's seat. When Law Enforcement approached the driver's seat they saw the Defendant seated behind the wheel. An odor of marijuana was detected by Law Enforcement and both occupants of the vehicle were ordered out of the car and a search was conducted. Law Enforcement found marijuana in the center console of the Defendant's vehicle. They also claimed that the Defendant admitted to owning the marijuana after being read her Miranda Rights. After reviewing the case we filed a Motion to Suppress which caused the State to drop the charges completely.
